TERMS AND CONDITIONS OF USE
The Hotel Crew Pad Network, LLC d/b/a The Hotel Crash Pad Network ("HCPN")
As a condition of access to accommodations provided by HCPN (the “Pad” or “pad”), the applicant (“Applicant” or “Member”) agrees to be legally bound by the following Terms and Conditions (the “Agreement”), as well as all applicable rules, policies, and procedures set forth in the HCPN Client Guide and any additional directives issued by HCPN via any form of communication:
1. Check-In/Check-Out Procedure
Applicant shall legibly and truthfully record his/her name, date, time, and assigned key number on the registration log or other designated documentation each time the Pad is accessed or vacated. No post-entry alterations are permitted.
2. Key Return and Room Vacating
Upon each departure from the hotel, regardless of anticipated return, Applicant shall (a) return the assigned key/card/fob to the designated key pouch, (b) complete the registration log truthfully, and (c) remove all personal belongings. Exceptions apply only as stated in the Client Guide or in written notice from HCPN.
3. Key Misuse and Re-Keying Fees
Failure to return the key as required may result in hotel-imposed re-keying fees, which shall be the responsibility of the Applicant. Noncompliance may also result in immediate revocation of access and forfeiture of all fees paid, including liability for overflow accommodations.
4. Use of Recording Devices
HCPN disclaims responsibility for any photographs, videos, or recordings made by others on premises. Applicant waives any claims and agrees to indemnify and hold HCPN harmless for any related damages.
5. Service Availability and Liability Waiver
HCPN disclaims any liability for service disruptions or unavailability. Applicant waives and releases any claims for damages arising from such events and agrees not to engage in disparagement of HCPN or its affiliates.
6. Non-Refund Policy
All accommodations are provided “as is.” No refunds, credits, or rollovers will be issued due to non-use for any reason, including personal circumstances, employment changes, or force majeure. Applicant acknowledges that monthly payment reserves exclusive access and precludes others.
7. No Warranties
Except as expressly stated herein or in the Client Guide, HCPN makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
8. No Landlord-Tenant Relationship
This Agreement does not create a tenancy. The Pad is provided solely for temporary lodging incidental to the Applicant’s airline employment duties.
9. No Guest Access
Guests are strictly prohibited. Applicant shall not share access credentials under penalty of law.
10. Duty-Related Use Only
Use of the Pad is limited to overnight stays directly related to airline duty (e.g., pre-/post-trip and reserve assignments). Personal or non-duty use is expressly prohibited.
11. Health Restriction
Applicant shall not enter the Pad while exhibiting symptoms of illness, under quarantine, or advised to isolate, regardless of perceived origin of symptoms.
12. Assumption of Health Risk
Applicant acknowledges and accepts the risk of exposure to infectious diseases, including COVID-19, and waives all related claims against HCPN.
13. Usage Limits
Access is limited by aggregate monthly and consecutive day/night maximums as outlined in the Client Guide. Applicant agrees to comply.
14. Automatic Payment Authorization
Access Fees for the following month are automatically charged on the 27th of each month via Applicant’s payment method on file. Late payments result in fees and suspension/revocation of access.
15. Reporting of Violations
HCPN reserves the right to report violations, including financial or conduct-related breaches, to the Applicant’s employer or regulatory authorities.
16. Deposit Terms
Deposits are refundable only if written notice of termination is provided to HCPN no later than 11:59 p.m. Eastern time on the 15th day of the final month of access. Failure to comply with the procedure or any rule may result in forfeiture.
17. Recovery of Costs
Applicant shall be liable for any costs or losses incurred by HCPN as a result of noncompliance, which may be recovered through charges to the payment method on file.
18. No Chargebacks
Applicant waives the right to initiate chargebacks for rendered services. Fraudulent nonpayment may be prosecuted under applicable laws.
19. Revocation of Access
Access is granted at HCPN’s sole discretion and may be revoked at any time.
20. Release and Indemnification
Applicant releases HCPN and its affiliates from all liability for injury, damage, or loss related to Pad usage. Applicant agrees to indemnify and hold harmless HCPN against any claims, damages, or legal actions arising therefrom.
21. Acknowledgment and Acceptance
By submitting application, Applicant affirms that they have read, understood, and agreed to be bound by these Terms and Conditions and all supplemental documentation and directives issued by HCPN.
